WHS Expert Witness in Canberra, ACT and Commonwealth

The ACT adopted the harmonised Work Health and Safety Act 2011. For Commonwealth employers and their employees, the Safety Rehabilitation and Compensation Act 1988 (SRC Act) applies, with Comcare as the statutory insurer and regulator. The distinction between state-scheme employees and Comcare-covered employees is important in Canberra matters, as many workers in the ACT are employed by Commonwealth agencies covered by Comcare rather than the ACT workers compensation scheme.

Canberra's workforce is dominated by Commonwealth and ACT Government departments and agencies. Public sector WHS matters are common, including psychosocial hazard claims from public servants experiencing workload, role conflict or workplace bullying, manual handling injuries in operational roles and occupational violence claims involving emergency services and custodial workers. Defence personnel matters also arise in the Canberra region.

Canberra is approximately 3 hours by road or 45 minutes by air from Sydney. As a Sydney-based expert, Karim can travel to Canberra for site inspections and hearings with minimal advance notice, typically same week for most matters. Same-day return to Sydney is straightforward for most Canberra engagements.

The ACT has its own Work Health and Safety Act 2011, enforced by WorkSafe ACT. Commonwealth agencies fall under the Commonwealth WHS Act 2011, with Comcare as regulator, and their employees' compensation claims run under the SRC Act 1988. Private sector ACT workers are covered by the Workers Compensation Act 1951 (ACT), which sets no statutory threshold for common law damages. Public liability claims are decided under the Civil Law (Wrongs) Act 2002 (ACT), with the principles on precautions against risk in section 43.
