Common law damages claims for seriously injured workers and public liability matters. The Uniform Civil Procedure Rules 2005 apply to expert evidence, including the joint conference requirements.
Larger common law damages claims and complex liability matters. The UCPR Expert Witness Code of Conduct applies. Karim has experience in matters involving senior and junior counsel in the Supreme Court.
WHS prosecution matters brought by SafeWork NSW. Expert evidence addresses whether the duty holder met the reasonably practicable standard under the WHS Act 2011 (NSW).
NSW WHS Act 2011 and Expert Witness Code
New South Wales adopted the harmonised Work Health and Safety Act 2011. SafeWork NSW administers the Act and brings prosecutions in the NSW Industrial Relations Commission. The Personal Injury Commission handles workers' compensation disputes, including common law damages claims for seriously injured workers.
The NSW Expert Witness Code of Conduct is set out in Schedule 7 of the Uniform Civil Procedure Rules 2005. All expert reports in NSW Supreme Court and District Court matters must comply with the code. The Personal Injury Commission has its own direction on expert evidence. Karim is familiar with both and prepares all reports accordingly.
