Brief-to-Counsel Collaboration
Barristers briefed in WHS proceedings often require more direct engagement with the expert than the instructing solicitor. The expert's opinions need to be understood in depth before they can be presented at hearing, and any areas of vulnerability in the opinion need to be identified and addressed well before the witness box.
Karim Ali welcomes direct engagement with briefed counsel at the pre-trial stage. He is accustomed to specialist conferences with senior and junior counsel to work through the technical WHS issues in a matter, to refine the presentation of the expert opinion for court and to prepare for likely cross-examination on the specific areas where his opinion may be challenged.
Direct briefs from counsel are also accepted where no instructing solicitor is involved, subject to the usual conflict and independence considerations.
Pre-Trial Expert Conferences
Pre-trial expert conferences between counsel and the expert allow the expert's opinions to be examined in depth, the anticipated cross-examination to be tested and the most effective way of presenting the technical evidence to be planned. These conferences are particularly valuable in matters where the expert's opinion on the reasonably practicable standard or causation is central to the case.
Karim is available for pre-trial conferences at counsel's chambers, by video or by telephone. He treats these conferences as an opportunity to ensure that counsel fully understands the basis and limitations of his opinion before the hearing, so there are no surprises in the witness box.
Where a joint expert conference has been ordered, Karim is available to discuss the issues to be addressed in the conference with briefed counsel before the conference takes place, so counsel understands the technical WHS issues that will be raised and can advise on any legal questions that may arise.
Oral Evidence and Cross-Examination Experience
Karim Ali has experience giving oral evidence in courts and tribunals across Australia. He understands the conventions of giving expert evidence, including the duty to acknowledge the limits of his expertise, to concede points under cross-examination that are genuinely concedable and to maintain his opinion on matters where he is well-founded in doing so.
An expert who capitulates under cross-examination on matters where their opinion is sound is more damaging to a case than an expert who was never called. Karim's approach in the witness box is to explain the technical WHS issues clearly, answer questions directly and defend his opinions where they are grounded in sound analysis, without over-extending his expertise or speculating beyond the evidence.

These conferences allow senior counsel to test the technical basis of the expert's opinion in depth, to identify the most effective way of presenting the opinion at hearing and to anticipate and prepare for the opposing expert's likely challenges.
Karim is available for specialist conferences at any stage of proceedings, from shortly after the report is delivered through to the day before the hearing. He understands that barrister preparation time is valuable and prepares thoroughly for these conferences so they can be used as efficiently as possible.
