The value of a WHS expert opinion in a plaintiff matter is to explain to the court, in terms accessible to a judge or tribunal member without technical WHS knowledge, what the duty holder was required to do, what they actually did and why any gap between those two positions created a foreseeable risk that caused the plaintiff's injury.

If the documents do not support a finding that the duty holder breached their WHS obligations, the report will say so. Discussing the likely scope and direction of the opinion before instructing avoids commissioning a report that does not serve the matter.

How Karim Approaches Plaintiff Instructions

Causation and Reasonably Practicable Analysis

In a plaintiff matter, the expert analysis addresses two core questions: whether the duty holder breached their WHS obligations and whether that breach caused or contributed to the injury. Both questions must be addressed for the plaintiff to succeed.

  • Reasonably Practicable Analysis

    Assessment of what controls were required, which were available and practicable, and which were not implemented. Where adequate controls would have prevented the incident, the analysis links the absence of those controls to the duty holder's breach. This is the core of the plaintiff's WHS case.

  • Causation Linking Failure to Injury

    Identification of the contributing risk factors that caused the incident, and the connection between each factor and the duty holder's conduct. Where multiple contributing factors are present, the analysis identifies whether any failure materially contributed to the risk that resulted in the plaintiff's injury.

  • Documents Required for Assessment

    Incident reports, witness statements, risk assessments, SWMS, training records, inspection logs and any investigation reports are the core documents. CCTV footage and photographs are valuable where available. An initial assessment can be provided with a limited document set to assist with the decision to proceed with a full report.

  • Engagement and Fee Transparency

    A fee estimate is provided before instructions are confirmed. The estimate covers the scope of work agreed with the instructing solicitor. Additional work required, such as a site inspection or attendance at a joint conference, is quoted separately. There are no hidden charges.

Independence and Code of Conduct

Every expert report prepared by Karim Ali is prepared in accordance with the expert witness code of conduct applicable to the court or tribunal in which the matter is proceeding. The report acknowledges the expert's duty to the court and confirms that the opinion is independent of the interests of the instructing party.

Plaintiff instructions are accepted on the same basis as defendant instructions. The opinion given is the same honest assessment of the WHS position based on the evidence available, regardless of who instructs. Solicitors can expect an opinion that will serve the matter, not one that simply says what the instructing party wants to hear.

Where the documents do not support a finding of breach, Karim will advise the instructing solicitor before a formal report is commissioned. This honest preliminary assessment is provided at no cost where the matter is discussed before instructions are confirmed.
