Mining Industry Safety
Expert Witness
Independent expert opinion on mining and resources industry WHS matters in Australian courts and tribunals. Mining-specific legislation, principal hazard management, safety and health management systems, coal and metalliferous mining frameworks.
Mining Industry Expert Witness Scope
The mining and resources industry is subject to a separate and specific WHS legislative framework in most Australian states and territories, distinct from the general WHS Act. Mining safety legislation imposes obligations on mine operators, site senior executives, supervisors and workers that differ in structure and specificity from the general harmonised WHS framework.
The expert witness role in mining matters is to assess whether the mine operator's safety and health management system was adequate, whether the principal hazards at the mine were identified and managed, whether the specific obligations imposed by mining legislation were met and whether any failures in the safety management system contributed to the incident.
Karim Ali provides WHS expert opinion on mining industry matters. His experience managing safety in high-hazard energy environments, including work with major resources sector contractors, provides relevant context for mining safety expert witness work. Instructions are accepted for coal, metalliferous and quarrying matters nationally.
Mining-Specific WHS Legislation by State
Each jurisdiction has its own mining safety legislation. The expert analysis identifies the applicable legislation for the specific mine and incident location and assesses compliance against the requirements of that legislation.
- NSW: Work Health and Safety (Mines and Petroleum Sites) Act 2013
- QLD: Coal Mining Safety and Health Act 1999 and Mining and Quarrying Safety and Health Act 1999
- WA: Work Health and Safety Act 2020 and Work Health and Safety (Mines) Regulations 2022 (since 31 March 2022)
- VIC: Occupational Health and Safety Act 2004 and OHS Regulations 2017 (mines provisions)
- SA: Work Health and Safety Act 2012, with mines provisions in Chapter 10 of the WHS Regulations 2012
- NT: Work Health and Safety (National Uniform Legislation) Act 2011
Mining and energy industries share many common hazards including confined spaces, isolation procedures and permit-to-work systems. See the energy and utilities WHS expert page for related context.
Coal vs Metalliferous Mining Frameworks
Coal mining and metalliferous mining are regulated separately in most Australian jurisdictions. The obligations of operators, site senior executives and workers differ between these frameworks. The analysis identifies the applicable framework and the specific obligations it imposes.
-
01Safety and Health Management System (SHMS)
Mining operators are required to prepare, implement and maintain an SHMS that identifies the principal hazards at the mine, the controls for each hazard and the monitoring and review arrangements. The analysis assesses whether the SHMS addressed the hazard that caused the incident and whether it was implemented in practice.
-
02Principal Hazard Management Plans
Mining legislation requires specific management plans for each principal hazard identified at the mine. These plans must address how the hazard is identified, assessed, controlled and monitored. Common principal hazards include ground stability, inrush, inundation, explosives, fire, explosion, radiation and airborne contaminants.
-
03Site Senior Executive Obligations
The site senior executive (SSE) is the senior person responsible for the mine. The SSE has personal obligations under mining safety legislation to ensure the safety and health management system is in place and functioning, to be on site when significant operations are conducted and to investigate reportable incidents. The analysis addresses whether SSE obligations were met.

04Common Mining Incident Types
Expert opinion is most commonly instructed in matters involving ground instability and rock falls, mobile plant and vehicle incidents, falls from height at surface operations, exposure to airborne contaminants, explosives incidents, and incidents involving conveyor and fixed plant systems. Each incident type requires analysis against the specific mining safety legislation and the relevant principal hazard management plan.
Safety and Health Management System Assessment
The SHMS assessment examines whether the mine operator's overall safety management system was adequate for the size, complexity and risk profile of the mine. It looks beyond individual incidents to assess the systemic arrangements that should have prevented the incident from occurring.
An SHMS that exists on paper but is not implemented in practice is a common finding in mining incident investigations. The analysis assesses both the adequacy of the documented system and the evidence of its actual implementation at the time of the incident.
- Identification and assessment of all principal hazards at the mine
- Principal hazard management plans for each identified hazard
- Risk management procedures for routine and non-routine work
- Competency and training requirements for each role at the mine
- Incident investigation and corrective action procedures
- Consultation and participation arrangements
- Performance monitoring and management review systems
- Emergency response and rescue arrangements
